I filed EMTALA complaints with every responsible body. In the same week Alta Bates tried to discharge me in active diabetic crisis, I notified:

  • CMS Region IX EMTALA Enforcement
  • California Dept. of Public Health
  • Medical Board of California
  • Sutter Health Corporate Compliance

That means this isn’t just me sounding an alarm into the void. The federal government, the state of California, the licensing board, and the hospital system itself have all been told.

Here is the correspondence I had with Rose Alameda of Sutter Health:

Toby, I EXPECT you to call her, and your contacts at Sutter Health, to convey the horror and urgency of this grim, illegal hospital policy. You once ran California’s healthcare system—you know exactly what this means. This is on your watch.)

And what they’ve been told is this: hospitals in California are refusing treatment in violation of the Emergency Medical Treatment and Labor Act.

That is not a “mistake.” It is not “miscommunication.”
It is a federal crime, and it is murderous.

When a hospital discharges a patient in active medical crisis, they are knowingly sending them out to die. That’s not a metaphor—it is death by policy. And the target populations are always the same: women, the unhoused, the chronically ill, anyone without insurance.

CMS itself notes: investigations can take weeks or months. But there is no ambiguity about the law: if you show up at an emergency department, you have the right to be stabilized and treated—regardless of your income, your housing status, or your insurance.


California Is On Notice

California leadership has now been directly notified. According to Substack’s own confirmation, Ben Douglas receives every one of my posts. That means his brother, Toby Douglas—currently Senior Vice President of National Medicaid Programs at Kaiser Permanente and formerly Director of the California Department of Health Care Services —has been informed.

The state itself therefore cannot claim ignorance.
California is on notice.
If violations continue, if patients die, the responsibility is not only federal—it is state.


Where Did All the Lawyers Go?

Here’s what makes this worse: these are slam-dunk, billion-dollar cases.

Any first-year lawyer can see the money here. EMTALA violations that lead to death or harm are not just malpractice—they’re federal crimes that expose hospitals to catastrophic liability. Yet the legal profession is silent.

Where are the thousands of lawyers in California who should be filing class actions, contingency suits, wrongful death claims?

They’ve vanished. Or worse—they’ve chosen to hide.

  • Protecting careers, not lives.
  • Keeping one eye on jobs at the very institutions they’d have to sue.
  • Letting people die rather than risking their place in the system.

So instead of armies of attorneys doing their jobs, it’s me—one woman in a tent—filing federal complaints, naming names, and forcing accountability. The only way to end this lawlessness in our country is to bring back the rule of law, piece by piece if necessary.


Billion-Dollar Crimes

These aren’t just violations. They’re billion-dollar lawsuits waiting to happen. Every time a hospital breaks EMTALA and a patient dies—or is forced out in crisis—the taxpayers of California have standing to sue.

Hospitals like Alta Bates and health systems like Sutter will only change when they feel it where they care most: their wallets.

These are not accidents. They are crimes. And crimes this large deserve consequences this large.

  • Because they know I’m a threat, and they want me gone.

  • Because hospitals refuse stabilization.

  • Because courts and police protect abusers.

  • Because $20 million stolen from me is shielded by law.

  • Because women and children are being slaughtered and tortured in silence while the government, authorities, and the press looks away.

“I won’t die today” should not need to be spoken in this country.
And yet — here I am, forced to say it.

So hear me clearly:
